2) BROCHURE / WEBSITE ACCURACY DISCLAIMER
All the information in the brochure and on the website has been prepared using available data at the time of publication. However, Mangaldarshan is not responsible for any printing or typographical errors.
Since the brochure may have been printed well before your booking, we reserve the right to update or change any details from the brochure or website.
Mangaldarshan reserves the right to modify any brochure or website information before or after your tour booking, due to unavoidable circumstances. We recommend confirming the latest information with us directly before booking.
Some itinerary routes, products, and services may have changed. The photos of meals, sightseeing, and properties are for reference purposes only and may differ from actual experiences. The distances between destinations and temperature figures are approximate and may vary based on travel, road, and weather conditions.
Additionally, hotels may sometimes be booked on the outskirts of the city, away from central locations.
3) CHANGES IN THE ITINERARY
Mangaldarshan reserves the right to alter, amend, change, or modify tour packages and itineraries before or during the tour. We will make every reasonable effort to inform you of such changes sufficiently in advance, either during the booking process or before your departure. If any changes occur during the tour, our tour professional or local representative will inform you, and we request your full cooperation in accepting these changes. Any grievances regarding itinerary or service changes, which are made due to unforeseen circumstances, will not be entertained during or after the tour.
Please note that promotional offers may include different terms and conditions, which will apply in addition to these general terms. Booking deposits, payment deadlines, and methods may also vary in such promotions and will supersede the standard terms mentioned here.
Changes may be required due to factors beyond our control such as Force Majeure events, strikes, fairs, festivals, sports events, weather conditions, traffic disruptions, overbooked hotels or flights, flight cancellations or rerouting, or restricted entry to certain places of interest. We generally avoid scheduling tours during large events like fairs, exhibitions, or sports tournaments when hotels are booked months in advance. However, if the tour takes place during such times, alternative accommodations may be arranged, possibly outside the city or in nearby locations.
Due to airline requirements, the points of entry or exit in a country may change. We may operate more than one coach per departure and, for convenience, may reverse or modify the itinerary.
Changes to the itinerary may also be necessary due to the actions, inactions, or conditions of the tour participants.
Mangaldarshan will not be liable for any refunds or compensation resulting from itinerary changes. If the alternative arrangements are of significantly higher quality than those initially offered, additional charges may apply at the time of booking or during the tour.
4) BOOKING A TOUR
Please read carefully and understand the contents of the Tour Brochure, website itinerary, the “Terms and Conditions,” Price Grid, and any other applicable documents, as all these will form part of your contract with Mangaldarshan.
We may require you to sign the Booking Form and other documents we deem necessary, including (without limitation) the “Terms and Conditions” and Price Grid.
Upon executing the booking documents and payment of the prescribed non-refundable, interest-free booking amount, a binding contract will come into existence.
We advise you to ensure, before making a booking, that you possess or can provide all required valid and genuine documents, including any professional qualifications necessary to apply for visas, insurance, etc.
If you are booking a tour or travel service from a third-party operator through us, the terms and conditions of such third-party operators, including their payment schedules, cancellation policies, and refunds, will apply in addition to Mangaldarshan’s Terms & Conditions.
In case one or more, but not all, tour clients listed on the Booking Form sign the booking documents, it will be deemed that the signatories have been authorized by all tour clients to sign on their behalf. The signatories will assume full responsibility, and it will be considered that all tour clients have signed the booking documents.
If a travel agent signs the booking documents on behalf of the clients, it will be deemed that all clients have authorized the agent to sign for them, assuming full responsibility.
Please note that there is no contract between Mangaldarshan and the tour clients until the booking documents are signed and received by us, along with the non-refundable, interest-free booking amount.
Full payment must be received according to the prescribed payment schedule. If not, Mangaldarshan reserves the right to cancel the booking, forfeit the booking amount, and apply a cancellation charge as per the brochure.
Any payment made to your travel agent will not constitute payment to Mangaldarshan until remitted to our account.
Mangaldarshan will not be held responsible if clients are unable to travel due to visa issues, including delays or errors in visa issuance. In such cases, cancellation charges as per the CANCELLATIONS clause will apply. For cancellation purposes, it will be deemed that the booking was canceled on the date we receive written intimation of visa rejection.
Guests who are not bonafide booked clients are not permitted on the tour or allowed to use any tour services.
5) CANCELLATIONS
a) Mangaldarshan reserves the right to revise or cancel a booked tour without providing any reason. This may occur due to circumstances beyond our control. In such cases, we will offer alternative tour dates or tours, or you may opt to travel as an individual traveler, not part of the group. If the alternative is unacceptable, we will refund the amount paid, deducting any costs incurred, within 45 days. However, Mangaldarshan is not liable for any reimbursement or damages beyond this refund if you choose to cancel.
b) If you wish to cancel your booking, you must inform us in writing. The cancellation will be effective from the date we receive your email or letter. Any claims must be directed to your insurance company.
c) The following cancellation charges will apply, regardless of the reason for cancellation:
- Up to 45 days before departure: Rs 500 per guest or 7% of Net Tour Price whichever is higher.
- 45-31 days before departure: 7% of Net Tour Price.
- 30-16 days before departure: 10% of Net Tour Price.
- 15-6 days before departure: 20% of Net Tour Price.
- No-show or after 6 days before departure: 100% of the tour cost.
d) In case of visa rejection, it will be considered a cancellation on the date we receive the rejection notice. Refer to our Visa Guidance section for further details.
e) If you fail to make payments on time or commit any default, Mangaldarshan may consider this a cancellation, applying the relevant cancellation charges from the date of notice.
f) If no cancellation is issued by us, but payment or default remains outstanding by the departure date, the booking will be considered canceled without notice, incurring the highest cancellation charge.
g) If you wish to amend your booking, the request must be in writing and is subject to availability.
Please note:
Changes will be treated as new bookings.
An alteration fee of INR 2,500 per person applies.
If the alteration occurs during the cancellation period, cancellation charges will apply as if a cancellation was made on the request date.
h) Requests to transfer from one tour to another 15 days before departure will be treated as a cancellation, with a transfer fee of INR 5,000 per person in addition to re-processing costs for visas, air tickets, hotels, etc. Cancellation charges will apply if transferred within the cancellation period.
6) REFUND AND R.O.E.
Refunds (if any) for changes and/or cancellations will be paid directly to you for bookings made directly with Mangaldarshan. For bookings routed through our Preferred Sales Agent (PSA) or your Travel Agent (TA), the refund will be routed through them. It will take at least 30 working days to process refunds.
Refunds will not be payable for any unutilized or partially utilized services (e.g. Airline tickets, meals, entrance fees, optional tours, hotels, sightseeing, etc.). The refund for the foreign exchange component of the tour will be refunded in INR only and at the current day’s rate of exchange of Mangaldarshan.
Third-party refunds, such as those for airlines, cruises, overseas suppliers, etc., could take between 30-90 working days, provided the relevant supporting documents are submitted to the company.
If a tour is canceled by Mangaldarshan, all monies will be refunded after deducting actual expenses incurred for visas, other services, etc.
7) OUR EXTENT OF SERVICES
Mangaldarshan is a travel and holiday organizer and acts as an agent between clients and various service providers. We inspect and select the services provided to you. However, we do not own, operate, or control any airline, shipping company, coach or coach company, hotel, transport, restaurant, kitchen caravan, or any other facility or provider, etc. that is engaged to provide services during your tour. Therefore, please carefully note that:
You will need to adhere to the conditions, rules, and regulations of each service provider;
If you cause any injury or damage affecting the service provider, you may be liable to the service provider. If the service provider recovers any monies from us for such injuries or damages, we shall separately charge you for the same;
We cannot be held responsible or liable for any delay, deficiency, injury, death, loss, or damage caused by the acts or defaults of such service providers, their employees, or agents.
8) MEALS AND SPECIAL REQUESTS
The menus are pre-set for meals during the tour. The types of meals are clearly indicated in the brochure. Unlike airlines, we cannot provide special meals.
We cannot guarantee special dietary requests except to the extent mentioned in the brochure and preferred by you. However, we reserve the right to change meal arrangements if necessary.
If, for any reason, you miss a meal offered by Mangaldarshan, no claim can be made for the missed and unutilized meal.
Special requests for room allocation, diet considerations on tours/cruises/flights, etc., must be made in writing at the time of booking. However, all such requests are subject to availability. Mangaldarshan will not be held responsible for claims of damages or loss if we are unable to fulfill such requests due to unavailability.
9) ACCOMMODATION
We select hotels that are convenient and comfortable, often based on the sightseeing itinerary. They may be located away from the city center to reduce travel time.
Due to favorable weather conditions in Europe, most hotels may not have air conditioning or fans.
All baggage and personal effects are your responsibility at all times. Mangaldarshan will not be liable for any loss of personal items from the hotel premises, coach, airport, or during travel or sightseeing. Some hotels may offer safe deposit lockers, which you can use at your own cost and risk. Mangaldarshan will not be responsible for any loss or theft from the lockers.
Hotels in Europe, the USA, Canada, and South America have modern facilities, such as attached toilets with showers/bathtubs, but may or may not offer room service.
We cannot guarantee the availability of adjoining rooms, interconnecting rooms, non-smoking rooms, or rooms on the same floor.
Since rooms are typically small, we recommend only two people per room for your comfort. Triple rooms are often no larger than twin rooms, with the third bed being a rollaway cot placed in a twin room for the duration of your stay.
A double room may either have a queen-sized bed or two single beds. If you request a queen-sized bed, it will be provided based on availability, as most hotel rooms in Europe are twin-bedded. If a queen-sized bed is unavailable, a twin-bedded room will be provided.
The hotels listed in the itinerary or hotels of a similar category will be used. Due to trade fairs, conventions, or sports events in some cities, hotels may be sold out more than two years in advance. In such cases, you may need to stay in hotels further from the city, and the itinerary may be altered.
Facilities such as mini-bars, pay-per-view television channels, laundry services, telephone use, etc., are not complimentary. Any use of these services will need to be paid for by you directly to the hotel and are not included in the tour cost. You must also adhere to the hotel’s check-in and check-out times.
Any damages caused to the hotel rooms, coach, restaurant, sightseeing venues, etc., during your tour will be payable by you. Mangaldarshan will not be held accountable for such damages.
The company is not responsible for sudden disruptions in telephone, internet services, or other amenities at the hotel. Mangaldarshan is also not accountable for the facilities provided (or not provided) in the room, bathroom, or hotel premises by the hotel or its staff.
Hotel staff actions do not fall under the direct purview of Mangaldarshan, and we will not be responsible for them.
10) VISAS
Please check with the sales staff to ensure there is sufficient time to process the visa for your chosen departure date.
You will be required to submit, along with your application, a set of documents as mentioned in the documentation checklist provided to you at the time of booking.
The company will not be responsible for any clerical errors regarding names, incorrect photographs, visa duration, or type (single/multiple entry) made by the consulate or embassy.
Please note that visa and immigration clearance decisions are entirely at the discretion of the respective consulates, embassies, or authorities. Mangaldarshan is not responsible for visa denials, delays, or any losses, expenses, or damages resulting from their decisions.
Additionally, Mangaldarshan is not liable in case of loss of documents provided by you in support of your visa application, as these documents are forwarded to the concerned consulate/embassy through third parties. While we will make our best efforts to trace lost documents, Mangaldarshan will not be held responsible if they cannot be found.
The cost of visa processing may or may not be included in your tour price. If you already possess the visa(s) or are obtaining the visa(s) independently, the company’s visa service charge will still apply, but only the actual visa cost will be refunded. There will be no refund of visa service charges in case of visa rejection.
11) COACH AND SEATING
We generally use air-conditioned or air-cooled coaches. In extreme weather conditions, the air conditioner may not function optimally. Mangaldarshan is not responsible for any malfunctions or defects in the coach or the behavior of the coach driver.
Seating is allocated on a rotation basis, and our tour professionals will assist you with this arrangement.
Some coaches may have an onboard washroom, which can only be used in emergency situations.
Mangaldarshan is not responsible for any lost valuables left behind in the coach.
Coach drivers are subject to restrictions on maximum driving hours per day and per week, and itineraries are planned accordingly. It is essential to follow the timings, itineraries, and schedules to ensure that all services are provided. If the schedule is interrupted for any reason, Mangaldarshan will not be held responsible, and no refund will be provided.
Please note that smoking, consumption of alcoholic beverages, and snacks are strictly prohibited on coaches.
Any damage caused to the coach by you will be payable to the bus company, and Mangaldarshan will not be held accountable.
12) AIRLINES
In any situation, Mangaldarshan is not liable for any loss of baggage, failure to provide a preferred meal, denied boarding despite confirmed tickets, quality of meals, flight delays, changes in flight schedules, or missed flights.
If you are booked on a particular airline and, due to reasons beyond our control, you are not allowed to board the flight, Mangaldarshan cannot be held responsible, and no claim can be made against the company.
Airport taxes or Airport Development Fees applicable above the tour cost will need to be paid if they increase after the brochure is printed. All airline bookings, cancellations, or changes are subject to the respective airline’s terms and conditions, which will be provided upon request if available.
Every airline has its own rules regarding baggage weight restrictions, which are subject to change. Please check the updated baggage rules with our sales staff.
Mangaldarshan is not liable for any inability to carry baggage or for any extra charges imposed by the airline. These charges must be paid directly to the airline. We are also not responsible for any loss or damage to baggage while in the airline’s custody.
If you are booked on a group fare ticket, seat allocation will only be done when you physically report to the check-in counter. It is recommended that you check in at least 3 to 4 hours before departure. Seat allocation is at the airline’s discretion, and Mangaldarshan cannot be held responsible if you do not receive seats together or your preferred seating.
If you are returning on a later date after the tour ends, it is your sole responsibility to re-confirm your return tickets 72 hours before departure.
13) DEVIATIONS
If you wish to travel in advance (before the published departure date) or return later than the tour’s end date, additional charges such as deviation charges and fare differences will apply, depending on seat availability and ticket validity. These charges will be advised by your sales staff or travel agent. Deviations can only be processed 30 days prior to the departure date.
Deviation requests must be submitted in writing at the time of booking. These requests are subject to availability, and Mangaldarshan does not hold seats for such deviations.
14) PAYMENTS
a) All payments for the tour cost must be made by the client to Mangaldarshan according to the procedure and time frame outlined below. Any payments made within 5 days prior to the tour departure must be paid in Cash/Demand Draft.
b) A copy of the PAN card will be required for any cash payments amounting to INR 25,000/- or more.
c) Payments towards the foreign exchange component of your tour will be calculated based on the ROE (rate of exchange) on the given day. The foreign exchange component under your Basic Travel Quota (BTQ) must be availed through Mangaldarshan. The client is required to pay the total tour cost component in Indian Rupees via a demand draft in favor of the Company/Bank. The pre-printed Basic Travel Quota form must be completed, signed, and submitted to request the requisite Foreign Exchange. Mangaldarshan will forward the form to the Authorized Dealer/Money Changer, who will release the required foreign exchange to the Company under the client’s Basic Travel Quota. According to the Reserve Bank of India guidelines, Indian passport holders can avail up to USD 10,000 or its equivalent per person in one calendar year for private or leisure travel. For business travel, individuals can avail a maximum of USD 25,000 per visit. In both cases, no more than USD 2,000 or its equivalent can be taken in cash.
d) Full payment must be made according to the schedule below. Failure to comply may result in cancellation of the booking or tour by Mangaldarshan, along with the forfeiture of the deposit and the imposition of cancellation charges as outlined.
e) Payment Schedule: Minimum per person payment required by the client:
- 30 days or more before the departure date: Booking Deposit 20% of Tour Cost.
- 29 – 7 days prior to departure: 60% of the Total Tour Cost.
- 6 – 1 days or less prior to departure: 20% of the Tour Cost.
- 100% payment required for any airline / train / premium activities booking.
f) GST as applicable on the amount paid will be collected with the third installment.
g) The rate of exchange will be calculated on the date of the final 100% payment for the foreign exchange component.
15) HEALTH AND INSURANCE
It is the responsibility of the traveler to inform Mangaldarshan of any medical conditions that could affect their ability to fully enjoy and participate in the tour arrangements. If such conditions could impact the group or any group member, the traveler must inform the company.
Some tours may not be suitable for all individuals based on pace or physical requirements, so travelers are encouraged to choose tours according to their health conditions.
Mangaldarshan reserves the right to request a written certification of medical fitness before departure. If a medical condition has not been disclosed, the company will not be liable for providing assistance or refunds.
It is necessary for travelers to obtain valid travel/health insurance before the tour begins, and Mangaldarshan is not responsible for arranging insurance.
Any claims made to the insurance company will be at the sole discretion of the insurance company.
Travelers must verify the accuracy and correctness of their insurance policy.
16) PRIVACY OF INFORMATION
a) Any information provided to Mangaldarshan will be treated as confidential. Only the necessary information will be shared with airlines, hotels, and service providers to ensure services during the tour. However, Mangaldarshan may be required to disclose the information if mandated by law, court orders, or regulations from government/statutory agencies with regulatory authority over the company.
17) COMMUNICATION
a) Any communication sent to the address or through contact details such as email or phone number, as provided by the traveler in the “Booking Form,” or to the travel agent through whom the booking was made, will be considered communicated and received by the traveler. Mangaldarshan is not responsible for any errors in communication on the part of the mode of communication or the travel agent in this regard.
18) SOME OTHER CONDITIONS FOR TRAVEL
Due to fire safety compliance regulations in Europe, hotels do not allow 4 guests in one room. Therefore, 2 adults and 2 children or 3 adults and 1 child cannot be accommodated in a single room. A maximum of 3 persons can be accommodated in a room.
A panoramic/orientation city tour means viewing sights and monuments from your coach while driving past. No stops or visits to the sights/monuments, and no photo stops may be provided.
All travelers must follow the tour itinerary and return to India as per the planned schedule. No refunds will be provided if the traveler fails to join the group at the start of the tour, joins later, or leaves before the tour ends. It is the traveler’s responsibility to reach the starting point of the tour and register with the Mangaldarshan representative at the specified place, date, and time.
If a traveler cannot reach the tour starting point for any reason (e.g., loss of baggage, travel documents), their booking will be treated as a “no show” and 100% cancellation charges will apply.
If a traveler or their family is forced to discontinue the tour for any reason (e.g., illness, death, loss of passport), no claims will be entertained for refunds for unutilized services.
If a traveler uses pre-tour services or air tickets (included in the main tour cost) but fails to join the group for the main tour, or cancels after using the air tickets or pre-tour services, it will be treated as a “no show,” and no refunds will be provided for the unused portion of the pre-tour or main tour.
Each of these conditions is severable from the others. If any provision is found invalid, illegal, or unenforceable, the remaining provisions will still be effective. Mangaldarshan’s liability, in any case, will not exceed the total amount paid or agreed to be paid for the tour and will not cover any consequential loss or additional expense.
Mangaldarshan reserves the right to withdraw tour membership from anyone whose behavior affects the smooth operation of the tour or the enjoyment/safety of other travelers. The company will not be liable to such persons. These immunities will apply to Mangaldarshan’s managers, tour managers, employees, servants, and agents, but not to independent contractors hired by the company.
Prices in this brochure were calculated based on rates prevailing at the time of printing. Mangaldarshan reserves the right to amend prices in case of currency fluctuations, changes in exchange rates, fuel costs, high season charges, or airline/rail charge hikes. Such increases must be paid in full before departure by the traveler.
If you book with your own travel agent and the booking includes Mangaldarshan arrangements, your contract is with your agent, and Mangaldarshan is simply acting as an agent for your travel agent.
If Mangaldarshan publishes a discount or benefit scheme, the company reserves the right to withdraw the offer at any time unless a specific assurance to the contrary is published.
Mangaldarshan shall not be liable for:
Any overstay expenses due to delays or changes in bus/air/train/ship services, cancellations due to sickness, weather conditions, strikes, wars, or any other cause.
Missed sightseeing or canceled programs after the tour begins due to unavoidable situations beyond our control.
Loss or damage of baggage by airlines, hotels, or coaches.
An initial deposit ensures registration/participation in the tour but does not guarantee services like tickets, visas, or hotel accommodation until full payment is made.
If only one or more passengers sign the ‘Booking Form,’ it is deemed that they are authorized to sign on behalf of the others.
Mangaldarshan cannot provide individual assistance for walking, dining, getting on/off transport vehicles, or other personal needs. A qualified companion must accompany travelers needing such assistance. If no companion is provided, the traveler joins the tour at their own risk.
The traveler’s passport must be valid for at least 6 months beyond the departure date.
Mangaldarshan reserves the right to publish group photos of passengers taken during the tour.
Distances, temperatures, and pre/post-tour accommodation prices in the brochure are approximate and subject to change.
Photos of meals and sightseeing in the brochure are for reference only and may differ from actual meals or sights.
For any adventure activities offered by Mangaldarshan, passengers participate at their own risk. Such activities may be risky, especially for heart patients, expectant mothers, or people with high/low blood pressure.
Tours will operate with a minimum of 25/30 full-paying passengers, as stated in each itinerary. If the group is smaller than this, a local representative will assist. If the tour operates with fewer than 15 adults on a seat-in-coach basis, drivers may also act as guides.
19) OTHER TERMS
a) There is no contract between Mangaldarshan and the traveler until we have received the initial booking deposit of INR 50,000/- per person.
b) Mangaldarshan reserves the right at any time and for any reason:
To terminate this contract after accepting the deposit but before the commencement of the tour without providing any reason. In the event that Mangaldarshan terminates the contract, the amount paid by the traveler will be refunded without any interest.
To amend, alter, vary, or withdraw any tour, holiday, excursion, airline, flight routing, facility, or discounts/concessions advertised or published. Mangaldarshan may substitute an independent contractor of a similar class if deemed advisable or necessary. In such cases, Mangaldarshan shall not be liable for any damage, additional expenses, or consequential loss suffered by travelers or for any compensation claims.
c) No person other than Mangaldarshan, in writing, has the authority to vary, add, amplify, or waive any stipulation, representation, term, or condition in the brochure.
d) In the event that Mangaldarshan exercises its right to amend or alter any services mentioned in the itinerary after the tour or holiday has been booked, the traveler shall have the option to:
Continue with the amended or altered tour, or
Accept an alternative tour or holiday offered by Mangaldarshan.
In either case, the traveler shall not be entitled to any damages, additional expenses, or consequential loss, and Mangaldarshan shall not be liable to provide any refunds.
e) If the traveler cancels the tour, the cancellation charges mentioned in these terms will apply, and the traveler will be liable to pay such charges to Mangaldarshan.
f) Mangaldarshan shall not be liable under any circumstances for:
Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss, or damage, howsoever caused.
Any act, omission, or default of an independent contractor or any other person employed by them in the provision of accommodation, refreshment, carriage, or other services for the traveler or any person traveling with them.
The temporary or permanent loss of, or damage to, baggage or personal effects, howsoever caused. In this condition, “howsoever caused” includes negligence by any person.
g) If the traveler has any complaint regarding the services provided by any independent contractor, they must notify the contractor in writing immediately and provide a copy to the tour professional of Mangaldarshan. This will enable Mangaldarshan to address the issue with the contractor and prevent future travelers from facing similar difficulties.
h) Any claim or complaint by the traveler must be notified to Mangaldarshan in writing within 7 days of the end of the holiday tour. Claims made after this period will not be entertained, and Mangaldarshan will not incur any liability.
The tour is subject to RBI/GOI rules and regulations. Part of the tour cost will be paid in EUR/USD out of your BTQ.
Force Majeure – Unavoidable Events
i) Mangaldarshan shall be excused from performing or punctually performing any of the terms, conditions, services, or tours if the performance is prevented or delayed by causes beyond reasonable control. Such causes include, but are not limited to, acts of God, riots, wars, accidents, embargoes, terror attacks, coups, strikes, natural calamities, requisitions (acts of government), or delays/negligence by independent contractors caused by such circumstances. Any additional costs incurred by Mangaldarshan for services provided to the traveler during a force majeure event shall be borne by the traveler.
j) All disputes or complaints regarding these terms and conditions, the tour, and services shall be subject to the jurisdiction of courts in Mumbai only.
k) Upon signing the booking form, these terms and conditions will be binding on both Mangaldarshan and the traveler. They will serve as the sole basis of the relationship between the parties, and all prior communications, whether oral or written, regarding the terms or conditions of the tour and services will be canceled, revoked, or terminated.
Acknowledgment:
On behalf of the persons named in the booking form, I have read and understood the terms and conditions as stated above and as mentioned in the brochure.
